Learned counsel for the respondent-bank submits that he has received notice of the appeal today itself. He further submits that he has tried to contact the law officer of the Bank, but he could not be connected, so he requires a week’s time to verify the averment as raised by the learned counsel for the appellant that the entire due, which is about Rs. 2.28 crores, has been deposited and what is the interest component till date.

Learned counsel for the appellant submits that inspite of the fact that the entire amount has been deposited, the Recovery Officer has passed the order that the property has already been auctioned, so the possession of the property may be handed over to the auction purchaser in view of facts and circumstances of the case.

As prayed by the learned counsel for the respondent-Bank, 10 days’ time is granted to take instruction in this regard.

List this case on 03.10.2023, by which time learned counsel for the respondent-Bank may take instruction. Till then the status quo qua the property in question shall be maintained by all the parties as it exists today.
