Defects as mentioned by the registry from 1 to 5 have been removed by Ld. Counsel. Defects reconciled.
Regarding affidavit in support of the Stay Application (I.A. No. 85/2023), it has been submitted by the Ld. Counsel that interim relief has been sought in the Appeal itself which is being supported by the affidavit, hence, fresh affidavit in support to the Stay Application is not required and will argue the same before the Hon’ble Court. Appellant has also submitted that page Nos. 173,174 and 179 are best readable copies available with him.
The instant Appeal has been filed under section 18 of the SARFAESI Act against interim order 21.01.2023 passed by DRT, Allahabad S.A. No. 600/2021. Expedite Application (I.A. No. 84/2023), Stay Application (I.A. No. 85/2023) have also been filed along with the Appeal.
Appellant has also filed proof of service to the Caveator in the instant matter.
