Present: Shri Shreshth Pandey, counsel for the appellant, Shri P. K. Mishra, Advocate files his Vakalatnama on behalf of the respondent-Bank and seeks time to file reply. Copy of the memo has been served upon the learned counsel for the respondent-Bank today in the court.

Learned counsel for the appellant submits that this court was not available, therefore he had filed a writ petition-C No. 23761/2022 before the Hon’ble High Court, in which an interim protection has been granted by staying the auction of the property. Therefore, the learned counsel prays for interim relief.

Learned counsel for the respondent-Bank submits that no auction has been held pursuant to the auction sale notice dated 15.07.2022 issued by the respondent-Bank, therefore, no interim may be granted to the appellant at this stage.

In view of the above, no interim order is required to be passed at this stage.

Let the respondent-Bank file reply by the next date.
