The applicant in this transfer petition has sought to get O.A. No.483/2018 on the files of D.R.T., Pune transferred to any of the D.R.Ts situated in Mumbai.
The first Respondent, a company that has gone into liquidation, is presently represented by a liquidator stationed in Mumbai, has been served.
It is submitted by the learned counsel appearing for the Appellant that there are several other matters including criminal cases, pending against the original borrower in Mumbai, and therefore, for the sake of convenience and the interest of the parties, it is appropriate that the matter be transferred from D.R.T., Pune to any of the D.R.Ts situated in Mumbai.
After having heard both sides I am convinced that the interest of justice demands and it is also appropriate for the convenience of all concerned that the O.A. be transferred to any of the D.R.Ts in Mumbai. And accordingly, O.A. No.483/2018 on the files of D.R.T., Pune stand transferred to D.R.T-II, Mumbai
