Counsel for the appellant is present and submits Delay Condonation Application with I.P.O. of Rs. 200/- towards court fee and also provides I.P.O. of Rs. 200/- towards court fee on Waiver Application. No pre deposit has been made. Waiver Application has been filed. As per the symbolic possession notice dated 25.10.2017 dues of Bank was Rs. 43,50,671=18P+ Interest (Page 31 of the appeal). It has been stated that the appellant is neither borrower nor guarantor. Ld. Counsel states that he will argue before the Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 03.08.2022 of DRT, Lucknow in M.A. No. 40/2021 arising out of S.A. No. 435/2018. Waiver Application (I.A. No. 693/2022) and Delay Condonation Application (I.A. No. 694/2022) have been filed.
