No pre deposit has been made. It has been stated in the affidavit accompanying the Waiver Application that the appellant are neither borrower nor guarantor but tenant. Hence, condition of pre-deposit is not applicable. However, it is observed that the Notice under section 13 (2) dated 05.04.2021 was issued to M/s Greenland Motors through its partners and bears the name of Shri Sunil Khetrapal as Partner (page No. 160 of the instant appeal) the appellant no. 1 and 3 are sons and appellant no. 2 is wife of Shri Sunil Khetrapal.

The instant Appeal has been filed under section 18 of the SARFAESI Act against interim order dated 03.12.2022 of DRT, Allahabad in S.A. No. 600/2021. Urgency Application (I.A. No. 661/2022), Waiver Application (I.A. No. 660/2022) and Stay Application (I.A. No. 659/2022), have been filed.
