Learned counsel for the appellants contends that without any notice, property of the appellants has been sold and possession of the same is likely to be taken pursuant to the order of the Nayab Tehsildar as referred to in para 2 of the urgency application. He further contends that a week’s time was granted to the appellant by the Nayab Tehsildar for handing over the possession of the property in question.
In view of the submission made as above, the learned counsel for the appellant is directed to serve a copy of the memo of appeal along with copy of urgency application upon the respondent-Bank today itself. If the notice is served upon the respondent-Bank, then the case be listed on 04.08.2022, otherwise the case shall be listed on the date already fixed i.e. 08.08.2022 for waiver.
