Appeal Dy. No. 35/2021 Date: 21.10.2022
Shri Nikhil Khandelwal Vs. Bank of India
Present: Shri V. K. Shukla, counsel for the appellant, Shri Alok Rai, Advocate holding brief of Shri Supriy Mishra, counsel for the respondent-Bank,
Perusal of the earlier order dated 19.10.2022 shows that on the last occasion, it was argued that the property was auctioned by the Bank and the sale has been confirmed as well as sale certificate has also been issued in favour of the auction purchaser, who is trying to create third party interest over the property in question.
The office report dated 20.10.2022 shows that no reply has been filed by the Bank to the delay, waiver and stay applications. Let the same be filed by the next date of listing.
List this case on 06.01.2023. Till then, the parties concerned are directed to maintain the status quo, as it exists today, qua the property in question.
