It is contended on behalf of the appellants that the case was listed before this Tribunal on 20.07.2021, but on account of poor connectivity, the learned counsel could not connect and the appeal was dismissed for non-prosecution. Time was given to the counsel for the respondent-Bank for filing reply to the restoration application, which has not been filed till date.
Cause mentioned in the application is sufficient, therefore, application for restoration is allowed and the order dated 20.07.2021, by which the appeal was dismissed for nonprosecution, is hereby recalled. Hence, the appeal is directed to be restored to its original number.
List this case on 11.11.2022 for waiver.
