This is an appeal preferred by the appellant challenging the impugned order dated 2/6/2020 passed by the Learned DRT, Siliguri. It appears that, after filing the appeal appellant invoked the jurisdiction of Hon’ble High Court of Calcutta under Article No. 227 which was decided on 9/6/2022. Petition was disposed of and liberty was granted to the Appellant to avail the remedies before the Appellate Tribunal in accordance with the law.

Thereafter appellant has moved this appeal. Apparently the appeal is time barred but no application for condo nation of delay or under section 5 of the Limitation Act is moved. On quarry being raised, learned counsel for the appellant submits that appeal is within time and the matter needs consideration.
