I.A. No. 331 of 2022.
An interim order was passed by the Hon’ble High Court at Calcutta in C.O. No. 27 of 2021 on 9th June, 2022. This order was extended till the next date of listing on 22nd July, 2022. Next date of listing was fixed on 24th August, 2022.
It appears that on 24th August, 2022, this interim order was not extended.
Learned Counsel for the Applicant submits that although the interim order was not extended, but it was also not vacated. Hence, it may be extended.
Copy of I.A. No. 331 of 2022 was served upon the Respondent No. 1 and 2. But they are not represented today.
Having considered the submissions made by the Learned Counsel and after perusal of record, I am of the view that I.A. No. 331 of 2022 is liable to be allowed. Accordingly, I.A. No. 331 of 2022 is allowed. Interim order dated 22nd July, 2022 shall remain in force till the next date of listing.
List on 7th November, 2022 for hearing of Appeal.
