I.A. No. 232/2022 is an application filed by the Appellant to impleaded the Legal Heirs of the deceased Respondent No.4 as additional Respondent Nos.4 (a) and 4 (b). A notice has been served on the proposed Respondents, but there is no objection forthcoming from them.
Hence, I.A. No. 232/2022 i.e. an application for impleadment of Additional Respondents is allowed and the consequential amendments shall be carried out within two weeks.
The learned counsel appearing for 1st Respondent Bank submits that the Original Appellant, DCB Bank has already assigned the debt to M/s. Asset Reconstruction Company (India) Ltd. and, therefore, the substitution of 1st Respondent is required to be done.
Appellant is directed to take necessary steps towards the substitution.
Post on 25.10.2022 for steps/reporting compliance.
