THE APPELLATE TRIBUNAL :
Heard the Learned Counsel for the parties and perused the record.
By order dated 2nd August, 2017 the order dated 15th July, 2013 passed by District Magistrate under Section 14 of the Sarfaesi Act 2002 with reference to Memo No. RM/SARFAESI/813/1(5) was summoned.
It appears that compliance of that order has not been made. Before proceeding further, it is necessary to peruse the order. It appears that in spite of sending letter, the record was not sent by the concerned authority. Thereafter on 3rd of May, 2018 Learned Counsel for the parties requested them to provide a copy of the order to ensure compliance of the order but till date it is not complied.
