Matter is listed for disposal of I.A. 425 of 2021, an application filed by Appellant praying for stay of operation of the order dated 5th August, 2021 passed by Learned DRT, Visakhapatnam.
Learned Counsel for Respondents submits that they had no knowledge of the date fixed today, hence opposition could not be filed.
Learned Counsel for the Appellant submits that there is an urgency in the matter keeping in view the directions

issued by the Learned DRT for re-delivering of the physical possession of the scheduled property to the SARFAESI Appellant forthwith.
Since objection could not be filed today, matter be listed on 30th August, 2022 for disposal of I.A. 425 of 2021. Opposition, if any, be filed in the meantime.
Opposition to the main appeal be filed within three weeks with advance copy to the Appellant. Rejoinder, if any, be filed before the next date of hearing.
In the meantime, till 30th August, 2022 operation of the impugned order dated 5th August, 2021, so far as it relates to re-delivering of the physical possession to the SARFAESI Appellant is concerned, shall remain stayed.
