Learned counsel for the appellant files application for substituting the legal heirs of respondent no. 2, which is barred by limitation. He submits that he shall file the application for condonation of delay occurred in filing the substitution application. Let the same be filed by the next date after serving upon the learned counsel for the respondents.
The office report dated 04.03.2022 shows that notices were sent to the respondent nos. 3 & 7, but neither A.D. Card nor envelopes have returned back till date. However, the counsel for the appellant is directed to take fresh steps within two weeks for service upon the said respondents by two modes i.e. Registered post with A.D. and speed post. Affidavit of service be filed by the next date.
