Learned counsel for the appellant submits that he has filed an application for withdrawal of the appeal on the ground that the respondent-Bank is agreed to refund the auction amount to the auction purchaser, which may be allowed and the appeal be dismissed as withdrawn.
Learned counsel for the respondent-Bank has no objection to the submission made by the learned counsel for the appellant for withdrawal of the appeal.
In view of the aforesaid, the application is allowed and the appeal is dismissed as withdrawn.
