Learned counsel for the appellant files proof of paper publication with regard to the service of notice upon the respondent no. 3 and also files postal receipts along with tracking report before this Tribunal stating that the person, who have been substituted, have been noticed.
Learned counsel for the respondent no. 1 submits that he is already representing the respondents no. 1 and the legal heirs of the respondent no. 2 and has filed reply. No one appears on behalf of the respondent no. 3 despite paper publication.
Learned counsel for the appellant submits that copy of the reply has not been served upon him, for which the learned counsel for the respondents undertakes to serve the same within 48 hours. Learned counsel for the appellant may file rejoinder by the next date.
