It is seen that M.A. 38/2020 is filed by the Appellants seeking relief to declare notice dated 31.12.2019 issued by Circle Officer, Kalmboli, is illegal, bad in law and without any jurisdiction and as such the Circle Officer and Respondent No.1 be restrained to take possession of the secured assets. The same was considered by this Tribunal and was dismissed with costs on 21.01.2020.
This Appeal is preferred challenging order dated 23.12.2019 in S.A. (Lodging) No. 813/2019 on the file of D.R.T.-I, Mumbai.
The application for waiver of pre-deposit i.e. M.A. No. 37/2020 was filed u/s 18 (1) of the SARFAESI Act and that application has been dismissed as withdrawn by the Appellant on 17.01.2020.
Since in view of the fact that M.A. No.38/2020 has been dismissed, the present Appeal is dismissed for default.
