Learned counsel for the respondent-Bank submits that the present appeal is filed on behalf of the third party, who is purchaser of the mortgaged flat. The original borrower has settled the loan account, therefore, there is no amount due against the borrower. Therefore, the present appeal has become infructuous. No one appears on behalf of the appellant even in the second round.
In view of the above, the present appeal is dismissed as having become infructuous. In case the appellant have any objection to the order passed today, he may file application for recall of the same.
Learned counsel for the respondent-Bank shall inform Shri S. K. Pandey about the order passed today in writing within 48 hours.
