Regular Appeal No. 191/2013 Date: 04.07.2022 Jyotiveer Singh Khorana Vs. Uttar Pradesh Financial Corporation and Ors.
No one is present on behalf of the appellant. The present appeal was filed on 19.09.2013 and thereafter, the matter was repeatedly being adjourned on the pretext that OTS proposal is pending consideration, which is apparent from the order-sheets of the present case. The order-sheets further show that during this period, the learned counsel for the appellant was also changed and the matter was got adjourned. The order-sheets also show that on 19.02.2020, 12.11.2020, 18.12.2020, 02.03.2021, 18.08.2021 and 08.03.2022, none was present on behalf of the appellant. In such callous way, the appeal has been pursued by the appellant.
The record reveals that notices were returned back in respect of Respondent nos. 2 to 9, therefore, vide order dated 08.03.2022, the appellant was directed to serve the notices upon the said respondents through publication in the newspapers having wide circulation in the area. However, the registry has intimated that the learned counsel for the appellant has not taken any steps for the same. Today also, none is present on behalf of the appellant.
In view of the above, it appears that the appellant is not interested in pursuing his case, therefore, the appeal is dismissed for want of prosecution.
