Ld. Counsel Mr. Nemani Srinivas appears for appellant. Ld. Counsel states that submission of affidavit of service is not complied as he has not received any instruction from his client.
As per the affidavit of service filed on 09.10.2018 it is observed that service upon respondent no.1 is confirmed whereas respondent no.2 & 3 are not confirmed. Hence, Ld. Counsel for appellant was directed for newspaper publication vide order dated 27.06.2022 and file affidavit of service.
It is observed from record that despite of several rounds of listing, Ld. Counsel for appellant is yet to file affidavit of service of newspaper publication in respect of respondent no.2 & 3.
The matter may be posted on 06/01/2023 before Hon’ble Chairperson at Cuttack Camp Court for direction.
