An application (IA/414/2022) along with affidavit of service were filed on 04.11.2022 by Ld. Counsel Mr. Nikung Berlia on behalf of Appellant with a request to refund the sum of Rs. 29,36,373.25 as pre-deposit along with interest accrued to the appellant.Out of two respondents, service had been done upon only respondent No. 2.
Ld. Counsel, for appellant files affidavit of hand service upon respondent No. 1,today.Hence, services upon both the respondents are confirmed.
Vide order dated 24.08.2022 passed by Hon’ble Chairperson; Appeal No. 73 of 2013 was dismissed in default.
In pursuance of order dated 03.07.2018,Rs.6,00,000/- and Rs.23,36,373/(total amounting Rs.29,36,373.00) had been deposited by the appellant with this Appellate Tribunal as pre deposit on 14.08.2018 and on 06.03.2019 respectively as per record available. Those amounts have been made in Fixed Deposit in Indian Bank (erstwhile Allahabad Bank) vide Account No. 50458856128 and 50484090194 with TDR No. 379841 and 380070 respectively.
