The present restoration application being M.A. No. 02/2022 has been filed for recalling the order dated 20.09.2021, by which the appeal was dismissed by this Tribunal for want of prosecution. It has been contended on behalf of the appellant that the erstwhile Oriental Bank of Commerce has merged with the appellant-Bank and the earlier counsel, who was appearing for the said Bank, has left the case after its amalgamation without any information to the present appellant, therefore, the Bank could not instruct its counsel to pursue the case listed on 20.09.2021. As soon as the appellant came to know about passing of the impugned order, the present restoration application has been moved as early as possible.
Let the notices be issued to the respondents on the restoration and delay condonation applications by two modes i.e. registered post with A.D. and speed post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
List this case on 25.07.2022 for service.
