Present: Shri V. K. Ojha, counsel for the appellant, Shri Bharat Kant, Advocate files his vakalatnama on behalf of the respondent.
The report of the Registrar dated 28.11.2022 shows that no pre-deposit has been made and the amount due to be paid by the appellant shown to be Rs. 1,19,31,945/- as per order dated 07.10.2022. It is also noted in the said report that earlier also an appeal under section 18 of the SARFAESI Act has been filed against the interim order dated 07.10.2022 passed by the DRT, Allahabad in the same S.A. No. 30/2022. Now the present appeal has been filed against the second interim order dated 22.11.2022 in the same S.A. It is contended by the learned counsel for the appellant that today the date is fixed for taking the physical possession and he is ready to deposit Rs. 17.00 lacs.
Be that as it may, the present appeal is disposed off with liberty to the appellant to move an appropriate application before the Tribunal below for redressal of any grievances, if so desired.
In view of the aforesaid, the present appeal is disposed off.
