Shri Sailesh Mishra,Adv. has filed an application on 25-03-2022 under sub-section (6) of Section 17 of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act,2002 Read with sub-section (5) of Section 17 of the said Act.
The MISC Application has been filed after 167 days from the date of the impugned Order dated-08-10-2021 passed by Ld. Presiding Officer DRT-3, Kolkata and order passed by Hon’ble High Court at Calcutta in C.O. No.1960 of 2021 dated 22-02-2022 is well within the limitation period of 30 days from the date of order passed on 22-022022.
Application fee of Rs.205/-has been paid vide T.R. No.115521 dated 25-03-2022.
Learned counsel of the applicant shall file the affidavit of service of application upon respondent before the date of hearing i.e. 05-05-2022.
Learned counsel for applicant shall serve the copy upon respondent within 7 days.
