Ld. Counsel Mr. Pijush Kanti Ray is present on behalf of Miscellaneous Applicant.
Ld. Counsel Mr. Nemai Kumar Rakshit appears for Respondent No. 1 and submits that restoration petition has not been received by them.
None appears for Respondent No. 2.
Ld. Counsel for appellant submits that out of two, respondent No. 1 already appears as per their email intimation and as the respondent No. 2 was not appearing in main appeal since inception despite of newspaper publication, restoration application was not served upon him. He also submits that copy of restoration petition will be served upon Respondent No.1 before next date. Hence he prays for placing the matter before the Hon’ble Chairperson.
Vide order dated 13/02/2020 of Hon’ble Chairperson, Appeal No.53 of 2014 was dismissed and hence Ld. Counsel for Appellant filed a restoration petition being Misc. Application No. 11 of 2020 on 13/03/2020.
Let the matter may be posted before Hon’ble Chairperson on 28/03/2023 for direction.
