M/s Ishika Arora, Advocate appears and states that her senior Shri Sandeep Arora, Advocate will file Vakalatnama on behalf of the Respondent-Bank in this case.

Shri Sanjesh Prasad, Ld. Counsel for the appellant is present. Ld. Counsel mentioned details of pre-deposit in the concerned Para of the Appeal.

Ld. Counsel has already provided 25% mandatory pre-deposit by way of D.D. No. 490616 dated 28.06.2022 (SBI) Rs. 5,75,000/(Rs. Five Lakh Seventy Five Thousand Only).

The aforesaid D.D. of Rs. 5.75 lakhs submitted towards mandatory pre-deposit may be kept in shape of FDR in the Bank as per practice. Office to take necessary Action in this regard.

Mandatory pre deposit i.e. 25% of the dues has been made. For waiver of condition of deposit of 50% of the dues Application has been filed. Ld. Counsel states that he will argue this point before Hon’ble Court.

The instant Appeal has been filed under section 18 of the SARFAESI Act against interim order dated 06.06.2022 of DRT, Patna in S.A. No. 246/2021. Waiver Application (I.A. No. 202/2022) has been filed with the Appeal.
