Shri , Anubhav Chandra, Ld. Counsel for the appellant is present and submits D.D. No. 821744 dated 21.09.2022 (SBI) for Rs. 99,800/(Rs. Ninety Nine Thousand Eight Hundred only) towards deficient court fee.
As regards delay Ld. Counsel states that limitation is covered by Hon’ble High Court of Judicature of Patna order dated 21.07.2022 in the instant matter (Page 162-164 of the appeal). Ld. Counsel has mentioned Pin Code in the Appeal and also submits certified copy of the impugned order. All defects except defect regarding pre- deposit are reconciled.
No pre deposit has been made. Waiver Application has been filed. In the Waiver Application it has been stated that against the dues of Rs. 26,23,11,029/- the Bank had realize Rs. 84 lakh through sale of property and appellant had deposited substantial amount from time to time in the loan account. Ld. Counsel states that he will argue this point before Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 24.05.2019 of DRT, Patna in S.A. No. 16/2019. Waiver Application (I.A. No. 301/2022) Exemption Application (I.A. No. 300/2022) has been filed.
