The Appellant has stated that he is neither a Borrower nor Guarantor. The Appellant entered into an agreement of sale in respect of a residential Flat with M.D. of Respondent No. 4 i.e. M/s Goswami Developers Pvt. Ltd. It is observed that as per Respondent Bank Auction Sale Notice (page 68 of the instant Appeal), the aforesaid Respondent No. 4 is Borrower/Guarantor.
The instant Application has been filed under section 18 of the SARFAESI Act against final order dated 12.10.2022 of DRT, Patna in S.A. No. 72/2013.
