Heard the learned counsels for the parties.

On the last occasion i.e. 22.09.2022, it was argued on behalf of the appellant that the sole question involved in the present case is, whether the appellant would be covered under the insurance cover of the ICICI Lombard, which is a sister concern of the respondent-Bank and it was intimated that the said matter was pending consideration before the National Consumer Protection Forum. On that date, the learned counsel for the respondent-Bank was busy before the Hon’ble High Court and could not appear before this Tribunal.

Today, the learned counsel for the respondent-Bank is present and states that the issue involved in the proceedings before the National Consumer Protection Forum is entirely different.

Learned counsel for the appellant contends that the sole beneficiary of the insurance cover is the respondent-Bank and not the legal heirs of deceased-appellant, therefore, the contention as raised by the learned counsel for the respondent-Bank is not correct and whatever is decided by the National Consumer Protection Forum, the parties should abide. It is further contended that the matter before the National Consumer Protection Forum is fixed on 17.11.2022.

On the next date, the order of the National Consumer Protection Forum be brought on record.
