The office report dated 08.12.2022 shows that as per tracking report, the respondent no. 3 has been noticed, but notice sent to the respondent no. 2 has returned back with remark “no such person resides at the given address”. No reply has been filed on behalf of the respondent-bank to the delay condonation application. Let the respondent nos. 1 and 3 file reply by the next date.
Learned counsel for the appellant is directed to take fresh steps within 10 days for service of notice upon the respondent no. 2 through publication in the newspapers having wide circulation in the area. Affidavit of service along with proof of publication be filed by the next date.
