“a) summon the entire record of the Eviction Petition bearing No. RC ARC 432/2024 titled as Shri Karam Chand Vs. Smt. Suman BhartI and peruse the same and consequently set aside the impugned order dated 16.07.2025 passed by Shri Vivek Kumar Agarwal, Additional Ren Controller-02 (Central), Tis Hazarl Courts, Delhi, passed in said Eviction Petition bearing No.RC ARC 432/2024 titled as Shri Karam Chand Vs. Smt. Suman Bharti and allow the present revision petition with costs throughout; b) pass such other and further order or direction that this Hon’ble Court may deem fit and proper in the circumstances of the present case in favour of the petitioner and against the Respondent.”

“1. Apropos the last order dated 18.12.2025, learned counsels for the parties submit that the parties have agreed that the petitioner/ tenant shall vacate the subject premises to handover the physical and peaceful possession thereof to the respondent/ landlord on or before 31.03.2026, as also pay user and occupation charges @ Rs.12,000/- per month in cash to the landlord, on or before the 7th day of each month.

Needless to say, the tenant shall pay/ clear all the arrears of electricity, water and RWA dues, if any, including all other statutory dues qua the subject premises, and handover all the requisite documents reflecting the payment(s) of each of the above to the landlord on or before the said date, i.e. 31.03.2026.

Learned counsel for the tenant seeks, and is granted, a period of two weeks for filing an affidavit in terms thereof.

As such. Renotify on 16.01.2026.”

On 16.01.2026, since none appeared on behalf of the petitioner, Court notice was issued to the petitioner. In pursuance of the same, learned counsel for the petitioner enters appearance today and submits that the latter had vacated the subject premise within 06 months of passing of the eviction order, i.e. , on 16.01.2026.

None appears on behalf of the respondent today.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the present petition.

Leave granted.

The present petition is dismissed as withdrawn and disposed of accordingly.
