It is submitted that the Cancellation Report was filed by the investigating agency way back on 08.04.2022 but so far, there is no decision on such Protest Petition and, therefore, quashing of instant FIR has been sought.

on advance notice and reveals that though the abovesaid Cancellation Report had been filed in the year 2022 but simultaneously, there is a protest petition which is pending consideration before the learned Trial Court and the next date of hearing is 28.02.2026.

Ideally, the petitioner should have highlighted the abovesaid aspect if the same was in his knowledge.

In view of the above, it will not be appropriate to consider the present quashing petition, merely, for the reason that the Cancellation Report has been filed as admittedly there is a Protest Petition which is also under consideration.

After hearing arguments for some time, learned counsel for the petitioner submits that he does not press the present petition at this juncture, but he may be granted liberty to file the petition afresh, in case the learned Trial Court takes cognizance of the matter, based on any observation appearing in the decision on abovesaid protest petition.

The present petition stands disposed of as not pressed.

Liberty, as prayed, is granted.

Simultaneously, learned Trial Court is also requested to expedite the disposal of the abovesaid protest petition.
