This contempt petition alleges non-compliance of the directions issued by this Court vide order dated 8^th October, 2025. The relevant extract of the said order reads as under:

“1. Mr. Romy Chako, learned Senior Counsel appearing on behalf of the petitioner invites attention of the Court to the order dated 11.09.2025 to contend that the direction given in the said order has not been complied with by the respondent no.2/DoE and the salary for the month of August has not been released to the staff of the school.

2. On the other hand, Mrs. Avnish Ahlawat, learned Standing Counsel appearing on behalf of the respondent no.1/GNCTD submits that the petitioner school has submitted bills for the month of August

2025, in respect of which the respondent no.2/DoE has raised certain objections, and the same have not been responded to by the petitioner. Furthermore, the school has not even deposited 5% towards its share in the salary of the staff.

3. Mr. Chako, on instructions, submits that the school’s 5% share will be deposited by the school within a period of one week. Upon deposit of the said amount, let challan of such deposit be furnished by the petitioner school to the respondent no.2/DoE, who shall release the salary for the entire month of August within three days thereafter.

4. Likewise, for the salary of September 2025, let school submit its bill and deposit its 5% share within a period of one week. The respondent no.2/DoE shall release the salary for the month of September, within a period of one week thereafter.

5. List on 07.11.2025 in the top five matters.

6. Dasti under signature of the Court Master.”

In terms of the aforesaid directions, the salary for the month of September 2025 was required to be released within the stipulated period, subject to compliance by the petitioners.

Mrs. Avnish Ahlawat, Standing Counsel appearing for Respondents No. 2 and 3, submits that the Petitioners had not deposited their requisite 5% share, on account of which the salary for the month of September 2025 could not initially be disbursed. In response, Mr. Anukul Raj, counsel for the Petitioners, states that the said amount has already been deposited. Let proof of deposit of the 5% share, along with the relevant salary bills, be furnished to the concerned Authority. Mrs. Ahlawat, on instructions from Mr. Mushtaque Ali, Respondent No. 4 (in-Person), DDE Zone-29 with Mr. Tanveer Alam, OSD, Distt, South-East, state that upon confirmation of deposit of the Petitioners’ 5% share, the salary for September 2025 shall be released.

At this stage, it is also noted that while Mrs. Ahlawat has submitted that the Department of Education shall abide by the directions of this Court, she clarifies that there is no stay operating against the impugned

administrative decision and that the Respondents reserve their rights and contentions to contest the Petitioners’ entitlement to seek disbursal of salaries, particularly in view of the stand that grant-in-aid to the Petitioners has already been stopped.

Accordingly, the contempt proceedings are closed, without prejudice to the rights and contentions of the Department of Education as noted above. 6. The present petition is accordingly disposed of, along with the pending application.
