The Petitioner seeks a writ of mandamus directing the Respondent to include hearing impairment as a specified disability in the Recruitment for Head Constable (Ministerial) in Delhi Police Examination, 2025, and to grant such other consequential reliefs in relation to reservation for Persons with Benchmark Disabilities, in accordance with Section 34 of the Rights of Persons with Disabilities Act, 2016.

At the outset, the Respondents have raised an objection to the maintainability of the present petition, contending that the grievances raised by the Petitioner can be effectively addressed before the Central

Counsel for the Petitioner does not dispute that such disputes are amenable to the jurisdiction of the CAT; however, it is urged that this Court ought to entertain the present petition, as it raises pertinent and important questions of law in relation to reservation for persons with benchmark disabilities.

The Court, however, is not inclined to entertain the present petition in view of the availability of an alternate efficacious remedy of approaching the Central Administrative Tribunal, in light of the law laid down by the Constitution Bench of the Supreme Court in L. Chandra Kumar v. Union of India .²

In view of the above, the petition is dismissed with liberty to the Petitioner to take recourse to appropriate remedies in accordance with law before the Central Administrative Tribunal. The pending application(s), if any, also stand disposed of.
