The present petition under Sections 11/12 of the Contempt of Courts Act seeks following prayers:-

“A. Initiate action/proceedings against the Respondent/Contemnor under the Contempt of Courts Act, 1971 for willfully disobeying the directions passed by this Hon'ble Court in the Judgment dated 18.12.2019, passed in LPA No. 928 of 2013, titled as 'Airports Authority of India v. Harbhajan Singh', and the said Contemnor may be tried and punished in accordance with law';

B. Issue directions to the Respondent /Contemnor to reinstate the Petitioner with immediate effect, along with all consequential benefits as to promotions and increments;

C. Issue directions to the Respondent /Contemnor to calculate and pay the Petitioner the remaining back-wages from the period of 01.05.2014 till December 2019;

D. Issue directions to the Respondent/Contemnor to pay the Petitioner a sum of Rs. 20,000/- (Rupees Twenty Thousand Only) as per the directions given in the Judgment dated 18.12.2019, passed in LPA No. 928 of 2013, titled as Airports Authority of India v. Harbhajan Singh' and

E. Pass any other order and/or direction, as this Hon'ble Court may deem fit proper under the facts and circumstances of the present case and in the interest of Justice.”

Vide judgment dated 18.12.2019 in LPA 928/2013 and LPA 183/2014 the following directions were passed:-

“54. For all of the aforementioned reasons, the Court is unable to find any error having been committed by the learned Single Judge in the directions issued by him requiring reinstatement of the Respondent with all consequential benefits and 50% back-wages. The said order will now get implemented forthwith by issuing the necessary orders not later than four weeks from today.

The appeal being LPA 928/2013 of the AAI is accordingly dismissed with costs of Rs. 20,000/- which shall be the AAI to the Respondent within four weeks from today.

In view of the above decision, this Court finds no reason to interfere with the impugned order, insofar as it restricts the back-wages to 50%. The appeal filed by the Respondent, being LPA 183/2014 is therefore, also dismissed. There shall be no orders as to costs.

The amount deposited in this Court by the AAI be released forthwith to the Respondent, Mr. Harbhajan Singh, together with the interest accrued thereon. If there is any discrepancy in the amount calculated by the AAI, it will be open to the Respondent to seek appropriate remedy in accordance with law.

Both the appears are disposed of in above terms.”

Compliance affidavit dated 27.05.2023 has been placed on record on behalf of the respondent.

Learned counsel appearing on behalf of the petitioner submits that the aforesaid directions have been complied with, however, certain issues with regard to perks, including leave encashment, further claim of 100% wages from the period of January 2020 till September 2020 and also excess

deduction of the Central Provident Fund are remaining. Learned counsel further seeks leave to withdraw the present petition with liberty to initiate appropriate proceedings in accordance with law with respect to the aforesaid issues.

The present petition is dismissed as withdrawn and disposed of accordingly.
