The present Petition, filed under Section 9 of the Arbitration and Conciliation Act, 1996 seeks the following reliefs:

“.....

a) Pass an order thereby directing the Respondent to deposit with this Hon'ble Court an amount of £ 437,767.56, presently equivalent to approximately INR 5,38,58,800 (Indian Rupees Five Crore Thirty Eight Lakh Fifty Eight Thousand Eight Hundred Only) towards the claim amount due to the Petitioner;

b) Alternatively, to prayer (a), direct the Respondent to furnish a bank guarantee from a scheduled bank for an amount equivalent to the amounts as mentioned in prayer (a) to secure the claim and interests of the Petitioner;

c) Restrain the Respondent from alienating, encumbering, transferring, selling, disposing off, parting with possession of or creating any third party right, title or interest of any nature whatsoever in respect of his assets/ investments/ properties/ entitlements both movable and immovable;

d) Restrain the directors and shareholders of the Respondent from leaving country without the permission of this Hon'ble Court; e) Direct the Respondent to disclose on oath all his properties

and assets and investments and entitlements, both movable and immovable, including without limitation income from rent and bank accounts and all particulars of its entitlement and or receivables from third parties including from companies in which the respondent is a shareholder or from trusts in which the Respondent is beneficiaries or from partnership firms in which the Respondent is a partner

f) Direct the Respondent to disclose on oath all his respective bank accounts and attach such accounts as deemed appropriate to the extent of £ 437,767.56 plus applicable taxes in United Kingdoms, equivalent to approximately INR 5,38,58,800 (Indian Rupees Five Crore Thirty Eight Lakh Fifty Eight Thousand Eight Hundred Only) towards the claim amount;

g) Pass ad-interim ex-parte orders in terms of prayers above, and;

h) Pass such other order(s), direction(s) as deemed fit and proper in the facts and circumstances of the case and in the interest of justice and equity.”

Learned Senior Counsel appearing on behalf of the Petitioner, after arguing for some time, on instructions, seeks the leave of this Court to withdraw the present Petition, with liberty to avail such remedies as may be available to the Petitioner in accordance with law. 3. Leave to withdraw the present Petition, along with the liberty as sought, is granted.

Accordingly, the present Petition, along with pending Application(s), if any, stands dismissed as withdrawn.
