The present writ petition has been filed seeking demolition action against the unauthorized construction being undertaken by respondent no. 3 in property bearing no. C-3/310, Janakpuri, New Delhi (‘subject property’), in the form of 3^rd Floor and 4^th Floor along with the roof.

In the order passed by this Court on 20^th March, 2026, it was noted that the 3^rd floor of the subject property has been regularised and demolition action was fixed in respect of 4^th floor of the subject property. However, the same could not be carried out.

A further compliance report has been handed over in Court on behalf of MCD which is taken on record. In the said report, it is stated that action against the unauthorised construction was taken on 25^th March, 2026, 21^st April, 2026 and 21^st May, 2026.

It is further stated that the property was inspected against on 15^th July, 2026 and it was found that owner/occupier of the 3^rd floor has removed the remaining structure at the 4^th floor of the property.

Taking note of the action taken by the respondent/MCD, the present writ petition stands disposed of.

It is made clear that respondent no. 3 shall not carry out any further unauthorised construction in the subject property.

¶19

Liberty is given to the petitioner to invoke appropriate remedy to challenge the regularisation of the 3^rd floor.
