The present writ petition has been filed seeking a direction to the respondent/Tata Power Delhi Distribution Ltd. (TPDDL) to install an electricity meter in the name of the petitioner at Plot measuring 241 sq. yds. forming part of Khasra No.70/1/2 situated in the revenue estate of Village Burari, now colony known as Sant Nagar, Burari, Delhi- 110084 (‘subject property’).

The petitioner claims to be the owner of the subject property in terms of a gift deed dated 20^th February, 2026. It is stated that there is an ongoing civil dispute relating to the said property being CS (DJ) 140/2026, which is pending before the Court of District Judge, Tis Hazari Courts, Delhi. The

petitioner has also moved an application under Order I Rule 10 of Civil Procedure Code, 1908 (CPC), seeking impleadment in the said dispute. Yet another suit being CS(COMM) 560/2026 for possession, recovery of arrears of rent and permanent injunction is also pending in relation to the said property. In the said suit also, the petitioner has filed application under Order I Rule 10 CPC seeking impleadment.

The petitioner applied for a new electricity connection at the subject property, which was rejected by the respondent.

Mr. Manish Kumar Srivastava, counsel appearing on behalf of the respondent/TPDDL, on advance notice, submits that there already exists an electricity connection at the subject property w.e.f. 8^th November, 2024. He further submits that the subject property was inspected yesterday and the said connection was found to be live.

From the facts as noted above, there appears to be a dispute with regard to title and possession of the subject property, which is pending before the District Court. Once there is already a live electricity connection at the subject property, a direction cannot be issued to the respondent for granting another electricity connection.

In light of the above, the relief sought in the present writ petition cannot be granted. Accordingly, the writ petition is dismissed.

Needless to state, the petitioner would have liberty to invoke appropriate remedies that may be available in law.
