The grievance of the petitioner is that the private respondents no.4 and 5 have broken the seal of the property bearing no. 108, Sarpanch ka Bara, Mandawali, Delhi-110092 (hereinafter ‘ subject property’). It is further stated that the private respondents no.4 and 5 have started construction activities and are in the process of selling/letting out the apartments in the subject property.

Status report has been filed on behalf of the respondent/MCD. However, the same is not on record.

4.1. A copy of the status report has been handed over in Court today and the same is taken on record.

In terms of the said status report, it is stated that a sealing order dated 12^th May, 2026 was passed against the subject property.

The owner/occupiers of the subject property had approached the Appellate Tribunal, MCD (‘ATMCD’) and ATMCD vide order dated 21^st May, 2026 has directed that no coercive action in pursuance of the aforesaid sealing order be taken against the subject property.

In light of the above, the present writ petition is disposed of while directing the respondent-MCD to take appropriate action based on the
