The present petition has been filed by the Petitioner-Hawkers Suraksha Foundation under Article 226 of the Constitution of India, inter alia , seeking issuance of an appropriate writ directing the Respondent to dissolve the Town Vending Committee (hereinafter, ‘TVC’ ). The prayers sought by the Petitioner in this petition are as under:

“(1) To issue a writ of mandamus or appropriate writ or direction or order directing the respondent to dissolving the TVC according to the Delhi Street Vendors (Protection of Livelihood and Regulation of street Vending) Rule 2017;

Mr. Sahoo, ld. Counsel for the Petitioner submits that the elections also have to be conducted as the term of the present TVC has already expired.

Mr. Peechara, ld. Counsel for the NDMC agrees that the term of the initial TVC has already expired. However, due to various delays in the surveys which were being conducted, the list of street vendors could not be finalized, hence the delay. Ld. Counsel submits that the Street Vending Plan has already been submitted to the Delhi Government for approval under Sections 21 and 9 of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.

Further, ld. Counsel for the NDMC submits that the NDMC has complete intention to constitute the TVC but in view of the delays which took place in the completion of the surveys, the TVC could not be constituted. Ld. Counsel submits that steps would be taken by the NDMC and an endeavour shall be made to constitute the TVC within a period of six months. In view thereof, the statement of Mr. Peechara is taken on record.

The Court has heard Mr. Sahoo, ld. Counsel for the Petitioner and Mr. Peechara, ld. Counsel for the New Delhi Municipal Council (hereinafter, ‘NDMC’ ). A perusal of Rules 14 and 15 of the Street Vendor (Protection of Livelihood & Regulation of Street Vending) Rule, 2017 (hereinafter, ‘Street Vendor Rules’ ) shows that the TVCs have to be constituted from amongst the street vendors and certain nominated members.

The Court has heard Mr. Sahoo, ld. Counsel for the Petitioner and Mr. Peechara, ld. Counsel for the New Delhi Municipal Council. A perusal of

Rules 14 and 15 of the Street Vendor Rules shows that the TVCs have to be constituted from amongst the street vendors and certain nominated members. 8. Let the NDMC commence the steps to constitute the new TVC in accordance with the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 and the Street Vendor Rules and an endeavour shall be made to complete the same within six months.

The petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
