The present petition has been filed by the Petitioners under Article 226 of the Constitution of India, inter alia , seeking release of compensation along with statutory benefits in respect of the acquisition of land comprising Khasra No. 63/7 min (2-05) and 65/9 min (0-04), total admeasuring 2 bigha 2 biswa , situated in the Revenue Estate of Village Pooth Khurd, New Delhi (hereinafter, ‘the subject land’) .

The Petitioners claim to be the legal heirs of late Shri. Ram Narayan and late Sh. Sube Singh, who are stated to have expired on 29th August, 2013

The case of the Petitioners is that the said land was acquired for public purpose of construction of a 100 meter wide road under the Planned Development of Delhi and the acquisition of the subject land was confirmed vide Award No. 02-2012/2013/DC/(NW) . However, despite acquisition of the subject land no compensation along with statutory benefits has been released to the Petitioners or the original owners.

It is also the case of the Petitioners that no notice under Section 9 and Section 12(2) of the Land Acquisition Act, 1894 (hereinafter, ‘Act, 1894’) was served upon the Petitioners or the original owners.

According to ld. Counsel for the Petitioners, several representations have been made to the Land Acquisition Collector seeking disbursal of compensation. However, no compensation or interest has been released in their favour.

From the submissions made by ld. Counsel for the Petitioners and ld. Counsel for the Land Acquisition Collector (hereinafter, ‘LAC’) , it appears that there is insufficiency of funds in the Outer North District of the LAC.

However, insufficiency of funds cannot be a reason for not releasing the compensation. The government is bound to release the compensation, whenever the land is acquired, and the land owners cannot be made to wait indefinitely for release of compensation.

Compensation ought to be released to the land owners, if not already released.

Under these circumstances, the Petitioners’ representations seeking payment of compensation shall be considered expeditiously and, upon due verification of their credentials, the same be decided within a period of four

months. In cases where the original land owner has expired, the legal heirs shall furnish the requisite documents, including proof of identity, succession certificate or legal heir certificate, before the LAC for release of the compensation in their favour.

The present petition is disposed of in these terms. All pending applications, if any, are also disposed of.
