The present writ petition has been filed seeking a direction to the respondent no.1/BSES RPL to install an electricity meter and release a new electricity connection to the petitioner at B-846, Gali No. 14, Jaitpur Extension, Part-II, Badarpur, New Delhi (hereinafter the ‘subject property’). 2. It is stated that the petitioner is in occupation of the subject property and has been denied electricity connection for over 15 months.

Mr. Rishabh Jain, counsel appearing on behalf of the respondent no.1/BSES RPL submits that the petitioner had approached the Consumer Grievance Redressal Forum (‘CGRF’) earlier. However, the CGRF vide

order dated 30^th June, 2025 has denied grant of electricity connection to the petitioner as there was a mismatch between the address given in the application form and the area.

Counsel for the respondent submits that the proper remedy for the petitioner, against the aforesaid order of the CGRF, would have been to approach to Ombudsman. It further is stated that officials of the respondent went on a site inspection visit. However, they were denied permission to take photographs or videos.

The Supreme Court, in Dilip (Dead) Through LRs. v. Satish & Ors. [Crl. Appeal No. 810/2022 decided on 13^th May, 2022], held that electricity is a fundamental necessity of a person in possession of a property, regardless of any civil dispute as to the legality of their possession. This Court also, in several orders, has directed electricity connections to be given in the names of the occupants, without prejudice to the rights and contentions to be adjudicated in any civil proceedings.

Electricity connection cannot be denied to the petitioner so long as the petitioner remains in settled possession of the premises. Ownership issues, if any, cannot come in the way of grant of electricity connection.

Accordingly, the petitioner is granted liberty to apply for a fresh electricity connection, subject to the following directions:

i. The petitioner will file a fresh application for grant of electricity connection with the respondent giving all particulars about the property in occupation.

¶21

ii. The respondent shall visit the site to verify that the petitioner and/or his family members are in occupation in the said premises.

iii. The petitioner will not cause any hindrance to the officials of the

respondent/BSES RPL taking photos or videos.

iv. Electricity granted would be subject to fulfilment of all codal and commercial formalities.

v. The petitioner shall provide the requisite security deposit.

¶30

Let the aforesaid exercise be done in an expeditious manner.

It is made clear that this order shall not be treated as having conferred any special equities or ownership, title or possessory rights in favour of the petitioner.

In view of the above, the present writ petition, along with pending applications, is disposed of.
