Badri Prasad Vs Ms National Cooperative Consumers Federation of India Ltd.

The Petitioner was working as a Lower Division Clerk with the National Cooperative Consumers’ Federation of India Ltd., an autonomous body under the administrative control of the Department of Consumer Affairs, Government of India, since 01^st November, 1983, and superannuated on 31^st May, 2024. He submits that although retiral benefits have been released, he has now realised that there is a deficiency in the amounts paid to him, contrary to his entitlement.

It is submitted that during the course of his service, the Petitioner was placed under suspension from 04^th February, 2016 to 02^nd June, 2017, during which period he was not paid full salary and other service benefits. His services were restored on 02^nd June, 2017. It is further submitted that, upon conclusion of the disciplinary proceedings, none of the charges levelled against the Petitioner were proved. In these circumstances, it is contended

that the Petitioner is entitled to full pay and allowances for the suspension period, along with consequential benefits including annual increments. Despite this, the amounts claimed for the said period have not been released. A representation dated 23^rd December, 2024 submitted by the Petitioner in this regard remains undecided.

In the present proceedings, the Petitioner, inter alia , impugns the office order placing him under suspension and seeks consequential directions for release of salary for the suspension period along with increments.

At this stage, since the Respondent is not represented and this Court has not issued notice, no observations are being made on the merits of the case or on the question of delay. However, considering that the Petitioner has already submitted a representation, this Court deems it appropriate to direct the Respondent to treat the present writ petition as a representation and decide the same within a period of eight weeks from today. In the event any amount is found payable to the Petitioner, the same shall be released.

In the event the Respondent concludes that no amount is payable, a speaking order shall be passed and communicated to the Petitioner. 6. All rights and contentions of the Respondent are kept open. The Petitioner shall be at liberty to avail appropriate remedies in accordance with law, if his grievance is not redressed. It is, however, clarified that the question of maintainability of any such petition shall be examined, if the need so arises.
