provisions of the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948. The Petitioners further state that the land in question stands urbanised and that the MCD is now the responsible authority to examine the issue of unauthorised encroachments.

In this regard, it must be noted that a Special Task Force,¹ headed by the Vice Chairman of the Delhi Development Authority, has been constituted as the nodal agency for dealing with issues pertaining to land encroachment. In such circumstances, in light of the judgments of the Division Bench of this Court in Devender v. GNCTD² and Himanshu v. East Delhi Municipal Corporation and Anr. ,³ the Petitioners must, at the first instance, approach the STF raising their grievances.

Accordingly, the present petition is disposed of with a direction that the petition be treated as a representation to the STF, which shall take action thereon expeditiously, in accordance with law.
