These applications have been filed seeking substitution of the applicant ‘M/s Sahakar Global SDMC JV LLP’ as the petitioner no.1 in place of ‘M/s Sahakar Global Limited – JV’.

It is stated that the applicant was incorporated as an LLP on 9^th May, 2021 and has assumed the business of the petitioner no.1, which was a joint venture consortium. Vide Addendum Agreement dated 13^th February, 2023, the applicant-LLP was constituted comprising M/s Sahakar Global Limited and M/s Skylark Infra Engineering 008 Private Limited. This has been recognized by MCD vide communication dated 12^th December, 2023.

In view thereof, since the interest of petitioner no.1 has devolved upon the applicant-LLP, the present applications have been filed to

For the reasons stated, Sahakar Global SDMC JV LLP is impleaded as the petitioner no.1 in place of M/s Sahakar Global Limited – JV and the amended memo of parties filed along with the applications are taken on record.

These applications have been filed by the petitioners to withdraw the present writ petitions with liberty to institute a commercial suit for recovery of the amount due along with interest against the respondent/MCD before the appropriate commercial court.

The petitioners claim that the benefit of Section 14 of the Limitation Act, 1963 may be granted to the petitioners for the period that the present writ petitions remained pending before this Court.

Mr. Sanjay Vashishtha, appearing on behalf of the respondent/MCD opposes the said request and submits that the benefit of Section 14 of the Limitation Act, 1963 can only be granted by the competent civil/commercial court where the suit is filed. He further submits that the petitioners should not be entitled to the benefit of interest for the period which the present writ petitions remained pending before this Court.

petitioners are entitled to the benefit of Section 14 of the Limitation Act, 1963, and the aspect of interest, can only be considered by the competent civil/commercial court where the suit is filed.

Accordingly, the present writ petitions are dismissed as withdrawn leaving it open to the petitioners to file a commercial suit before the competent civil/commercial court.

The petitioners shall be entitled to apply for the benefit of Section 14 of the Limitation Act, 1963 before the competent civil/commercial court.

These applications have been filed by the petitioners seeking waiver of the requirement of two months’ prior notice to the respondent/MCD under Section 478(1) of the Delhi Municipal Corporation Act, 1957 for institution of the proposed commercial suit.

Mr. Mukul Talwar, Senior Counsel appearing on behalf of petitioner does not press these applications stating that an appropriate application in this regard shall be filed before the competent civil/commercial court.

Accordingly, the present applications are dismissed as not pressed.
