The present writ petition has been filed seeking a direction to the respondents no.1 and 2 to seal and demolish the unauthorized construction at property bearing No. 10578, Gali No.1, Shyam Ji Mal Line, Motia Khan, Delhi – 110055 (‘subject property’).

It is stated that the respondent no.1/MCD has issued a Work Stop Notice dated 24^th July, 2026 directing immediate stoppage of the unauthorized construction. However, despite the issuance of the said Work Stop Notice, the private respondent no.3 is carrying out illegal construction. 3. Photographs have been filed along with the writ petition showing the unauthorized construction (Annexures P-4 and P-5 to the writ petition).

Ms. Shilpa Dewan, counsel appearing on behalf of the respondent no.1/MCD on advance notice submits that a Show Cause Notice has been issued to the private respondent no.3 in respect of unauthorized construction in the shape of ground floor and first floor.

4.1 Copy of the same has been handed over in Court and the same is taken on record.

In view thereof, the present writ petition is disposed of while directing the respondent no.1/MCD to take appropriate action in accordance with law in an expeditious manner.

A direction is issued to SHO, P.S. Nabi Karim to ensure that there is strict compliance of the abovesaid Work Stop Notice and no unauthorized construction is permitted to be carried out on the subject property.

Mr. Niraj Kumar, Advocate who is present in Court and represents Delhi Police has been asked to communicate this order to the concerned SHO.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

All rights, contentions and legal remedies of the private respondent are kept open.

Pending application stands disposed of.
