The grievance of the petitioner is that the property of the petitioner bearing Khasra No.215, Plot No.139, A2 Wireless Colony, Mandey Road, Chhatarpur, New Delhi-110074 (hereinafter ‘subject property’) has been demolished in an arbitrary and illegal manner and therefore, the petitioner seeks compensation.

Status report has been filed on behalf of the respondent/MCD on 30^th August, 2025. In the status report, it is stated as follows:

i. The subject property was booked for unauthorised construction on 1^st September, 2020. After following due process of law, a demolition order was passed on 9^th September, 2020, pursuant to which, demolition action was carried out against the subject property on 4^th November, 2020.

ii. A writ petition being W.P.(C) 5661/2020 titled “ Wireless Colony New Mangla Puri Mandi Road RWA v. MCD” was filed alleging unauthorised construction in the subject property and vide orders dated 26^th August, 2020 and 4^th November, 2020, MCD was directed to take action against the unauthorised construction. Accordingly, it is stated that action against the property of the petitioner was taken after following due process of law.

On 2^nd September, 2025 and 28^th November, 2025, counsel for the petitioner took time to file response to the aforesaid status report. However,

till date, no response to the status report has been filed.

In view of the stand taken by the respondent/MCD in the status report, this Court does not find any illegality in the action taken by the respondent/MCD qua the property of the petitioner.

In any event, the relief of compensation as claimed in the present writ petition cannot be adjudicated in the present writ petition.

Accordingly, the present writ petition is dismissed.

¶29

Liberty is given to the petitioner to file appropriate proceedings in accordance with law in case any further grievance survives.
