Acting on a request letter dated 28.04.2025 of the Special Judge (NDPS-02), Central, Delhi and the order dated 19.04.2025 of the Principal District and Sessions Judge, Central, Delhi, the Court held that since the designated courts dealing with National Investigation Agency Act matters are housed at Patiala House Courts, New Delhi, case FIR No. 930/2014 under Sections 489B/489C IPC, Police Station Kotwali (State Vs. Sarvind Yadav) should be transferred from the Court of the Special Judge (NDPS-02), Central, Delhi to the District and Sessions Judge, Patiala House Courts, who was directed to allocate the matter to an appropriate NIA Act court. The present petition for transfer of case FIR No. 930/2014, under Sections 489B/489C IPC, Police Station Kotwali, titled as State Vs. Sarvind Yadav has been instituted pursuant to the order passed by Registrar General of this Court dated 13^th May, 2025. In light of request letter dated 28^th April, 2025 of Sh. Pranjal Aneja, Special Judge (NDPS-02), Central, Delhi, this petition is accompanied with the judicial file of the above FIR case and also the order passed by the learned Principal District and Sessions Judge, Central, Delhi. The order dated 19^th April, 2025 passed by the Principal District and Sessions Judge, reads as under:

“File has been received vide order dated 19.04.2025 of Sh. Pranjal Aneja, Ld. Special Judge (NDPS-02), Central, Delhi. As per, Ld. Special Judge (NDPS- 02), Central, Delhi, this matter is required to be tried under National Investigation Agency Act.

There are designated courts dealing with NIA Act matters at Patiala House Courts. Accordingly, present matter be put up before Ld. Registrar General, Hon’ble High Court of Delhi, New Delhi for appropriate orders.”

Vide minutes dated 15^th April, 2019 of the Hon’ble Administrative and General Supervision committee of this Court, resolved as under:-

“The resolution dated 16.01.2017 of this Committee has been reconsidered. It has been resolved to substitute the word "reference" with "transfer petition" in the said resolution. Therefore, henceforth, the request received from District & Sessions Judges and Principal Judges, Family Courts for transfer of case from one District to another District, subordinate to the High Court and competent to try or dispose of the same, upon recusal or for any other reason, shall be placed by the Registry by way of transfer petition before the concerned Bench for appropriate consideration and orders.”

Since the designated courts dealing with the matters relating to National Investigation Agency Act are housed at Patiala House Courts, New Delhi, it would be appropriate to transfer the case FIR No.930/2014, Police Station Kotwali, titled State Vs. Sarvind Yadav from the Court of Sh.Pranjal Aneja, Special Judge (NDPS-02), Central, Delhi to District and Sessions Judge, Patiala House Courts, New Delhi, who shall allocate this matter to an appropriate Court dealing with NIA Act matters.
