By virtue of the present petition, the petitioner seeks transfer of respondent’s divorce petition being HMA No. 2961/2023, presently pending before the learned Principal Judge, Family Court, North-West District Rohini to Dwarka District Courts, South West Delhi District.

It is the case of the petitioner that she was married to the respondent in the year 2005, and out of the said wedlock a son was born in the year 2006. As per petitioner, since she was treated with utmost cruelty, she left her matrimonial home and is residing at her parent’s house at Rajapuri, New Delhi.

Learned counsel for the petitioner, appearing through video conferencing, primarily submits that since the petitioner is currently employed as a Senior Personal Assistant in the Dwarka Courts as also since the respondent himself is working at the EPFO complex in Sector 23, Dwarka, New Delhi which is near to the Dwarka Courts, coupled with

the fact the petitioner had already filed various proceeding inter se the parties before the learned Dwarka Courts, it will be in the interest and convenience of the petitioner to transfer the respondent’s divorce petition being HMA no. 2961/2023 under Section 13(1)(ia) & (ib) of the Hindu Marriage Act, 1955, presently pending before the learned Rohini Courts to the learned Dwarka Courts.

Learned counsel for the respondent, on the other hand, submits that since the petitioner herself is in a transferable job and will not be permanently posted in Dwarka Courts, New Delhi always, as also since the son of the parties, who is currently residing with the petitioner, is already a major, there is no reason for allowing the present transfer petition.

In rejoinder, learned counsel for the petitioner submits that though the petitioner was transferred to Karkardooma Courts, New Delhi, she has sought transfer back to Dwarka Courts, New Delhi.

Considering the factual matrix involved, as also the fact that the petitioner herself is in a transferable job, and she is able bodied and well placed with the support of a major son residing with her, alas, this Court finds no reason for allowing the present petition.

In view of the above, the present petition stands dismissed.
